關于加強產品質量檢驗機構監督管理的若干意見

    為了進一步加強對產品質量檢驗機構(包括省級以上質量技術監督部門依法設置和依法授權的產品質量檢驗機構,以下簡稱“檢驗機構(gou)”)的監督管理,提高產品質量檢驗機構的檢驗能力和競爭力,加強行風建設,規范檢驗行為,促進產品質量檢驗機構建立自律機制,確保產品質量檢驗工作科學、公正、廉潔、高效,提出以下意見。

一、充分認識加強檢驗機構監管的重要性和必要性

(一)檢驗(yan)機(ji)構是產品質(zhi)量監督工作的重要技術(shu)保障(zhang)。我國產品質量檢驗(yan)機構經(jing)過(guo)20多年(nian)的(de)發(fa)展,已形成(cheng)(cheng)了由國家、省、市(地(di))、縣4級檢驗(yan)機構組成(cheng)(cheng)的(de)產品質量監督(du)檢驗(yan)體系,為(wei)履行(xing)行(xing)政職能提(ti)供(gong)了(le)技(ji)術(shu)支撐(cheng),為(wei)社會安全(quan)與經濟發(fa)展提(ti)供(gong)了(le)技(ji)術(shu)保障,為(wei)產(chan)業發(fa)展提(ti)供(gong)了(le)技(ji)術(shu)服務,在規范企(qi)業(ye)的(de)生產、銷售行為,提高(gao)產品(pin)質量(liang)和提高(gao)產品(pin)競爭力中發揮了重要的(de)作用,為促進(jin)國(guo)民經濟建設和社會發展做出了重要貢獻(xian),已成為產品(pin)質量(liang)監督工作的(de)重要組成部(bu)分。

(二)嚴格履(lv)行行政職責,加強對檢驗機構的監管(guan)。國(guo)務(wu)院和地(di)方人民(min)政府(fu)依法賦予了質量技術(shu)監督(du)部(bu)門(men)對檢(jian)驗機構實施監管的(de)職能。各(ge)級質量技術(shu)監督(du)部(bu)門(men)要按(an)照“有權必有責(ze),用權受監督,違規必追(zhui)究,侵權需賠償”的原則,加(jia)強對檢(jian)(jian)驗(yan)(yan)機(ji)構(gou)監管(guan)工作(zuo),切(qie)實行(xing)使好國家賦予(yu)的行(xing)政職能(neng),嚴格履行(xing)各(ge)自(zi)的職責,并依(yi)法(fa)肩(jian)負起相應的監管(guan)責任(ren),保證檢(jian)(jian)驗(yan)(yan)機(ji)構(gou)依(yi)法(fa)開展產品質(zhi)量檢(jian)(jian)驗(yan)(yan)工作(zuo)。

(三(san))提(ti)升檢(jian)驗(yan)(yan)機(ji)構檢(jian)驗(yan)(yan)能(neng)力和國際競爭力,促進產品質量(liang)穩步提(ti)高。我(wo)國社會主義(yi)市場(chang)經濟的(de)發展(zhan),技(ji)術性貿易(yi)壁壘(lei)帶來(lai)的(de)嚴峻挑戰(zhan),對(dui)產品(pin)質(zhi)量檢(jian)(jian)(jian)驗(yan)能力(li)的(de)要(yao)(yao)求(qiu)越(yue)(yue)(yue)來(lai)越(yue)(yue)(yue)高(gao)。我(wo)國檢(jian)(jian)(jian)驗(yan)市場(chang)的(de)放開,使(shi)越(yue)(yue)(yue)來(lai)越(yue)(yue)(yue)多的(de)國外知名產品(pin)質(zhi)量檢(jian)(jian)(jian)驗(yan)機構(gou)進入國內檢(jian)(jian)(jian)驗(yan)市場(chang),對(dui)我(wo)國檢(jian)(jian)(jian)驗(yan)機構(gou)的(de)生存和發展(zhan)帶來(lai)挑戰(zhan)。因此,檢(jian)(jian)(jian)驗(yan)機構(gou)需(xu)要(yao)(yao)嚴格內部管理,努力(li)提(ti)升檢(jian)(jian)(jian)驗(yan)能力(li),為破解技(ji)術性貿易(yi)壁壘(lei)提(ti)供技(ji)術保障,提(ti)高(gao)市場(chang)競爭力(li),滿足我(wo)國經濟發展(zhan)的(de)需(xu)要(yao)(yao)。

二、強化內部管理、嚴格自律、不斷提升檢驗能力

(四)建(jian)立運行有(you)效的質量管(guan)理制(zhi)度。檢驗機構要(yao)按照《GB/T 15481檢測和校準實驗室能(neng)力的通用要求(qiu)(idt ISO/IEC 17025)》完善(shan)質量管(guan)理體系,要按照質量管(guan)理體系要求(qiu)開展工作,保證質量體系運行(xing)(xing)(xing)的(de)有(you)效性。要按照工作環節明確各(ge)類檢(jian)驗和管理人員(yuan)的(de)職責,實(shi)行(xing)(xing)(xing)檢(jian)驗人員(yuan)、抽(chou)樣(yang)人員(yuan)、檢(jian)驗機(ji)構負責人分(fen)工負責制,認真(zhen)執行(xing)(xing)(xing)檢(jian)驗、審核、批準的(de)報(bao)告審批程序。要建立科(ke)學(xue)的(de)抽(chou)樣(yang)與檢(jian)驗制度,在執行(xing)(xing)(xing)監督檢(jian)驗抽(chou)樣(yang)時,要采用隨(sui)機(ji)抽(chou)樣(yang)方法(fa),實(shi)行(xing)(xing)(xing)抽(chou)檢(jian)分(fen)離制度。

(五(wu))建立檢驗報告規范制(zhi)度(du)。檢(jian)驗(yan)機構出具的(de)(de)檢(jian)驗(yan)報告(gao)中所有信(xin)息要清晰、準確(que)(que)(que),避免誤(wu)導使(shi)用報告(gao)的(de)(de)任何(he)一方(fang)。屬監督檢(jian)驗(yan)行為的(de)(de),要嚴格執行規定格式(shi);屬委托檢(jian)驗(yan)的(de)(de),要規范(fan)報告(gao)的(de)(de)格式(shi)和內容(rong),報告(gao)內容(rong)要明確(que)(que)(que)檢(jian)驗(yan)樣(yang)(yang)品(pin)獲取的(de)(de)方(fang)式(shi)(如抽樣(yang)(yang)、送樣(yang)(yang)),明確(que)(que)(que)送樣(yang)(yang)檢(jian)驗(yan)產(chan)品(pin)的(de)(de)生產(chan)者確(que)(que)(que)認(ren)情況(如已確(que)(que)(que)認(ren)、未確(que)(que)(que)認(ren)、標稱(cheng)),明確(que)(que)(que)關于免責、限(xian)定條件的(de)(de)信(xin)息。

(六)建立(li)檢驗樣(yang)品(pin)的保(bao)存備查制度。檢驗(yan)機(ji)構要(yao)加強對檢驗(yan)樣(yang)(yang)(yang)(yang)品(pin)(或(huo)備樣(yang)(yang)(yang)(yang))的(de)(de)管(guan)理,要(yao)建(jian)立樣(yang)(yang)(yang)(yang)品(pin)登記、編號、流轉、保(bao)(bao)存(cun)、退回(hui)等(deng)流程(cheng)記錄,保(bao)(bao)證(zheng)樣(yang)(yang)(yang)(yang)品(pin)(或(huo)備樣(yang)(yang)(yang)(yang))保(bao)(bao)存(cun)完好或(huo)可追(zhui)溯備查(無(wu)法再現(xian)檢測結果的(de)(de)樣(yang)(yang)(yang)(yang)品(pin)除外),確(que)保(bao)(bao)在檢驗(yan)報(bao)告簽發后(hou)的(de)(de)3個(ge)月(yue)內(保(bao)(bao)質期不到3個(ge)月(yue)的(de)(de)產(chan)品(pin),以保(bao)(bao)質期為準(zhun),特殊(shu)產(chan)品(pin)另行規定)可實現(xian)對檢驗(yan)樣(yang)(yang)(yang)(yang)品(pin)(或(huo)備樣(yang)(yang)(yang)(yang))的(de)(de)再復核或(huo)復檢,保(bao)(bao)證(zheng)檢驗(yan)結果的(de)(de)真實性(xing)和準(zhun)確(que)性(xing)。

(七)建立科學研究和檢驗技(ji)術能力(li)提升制度。檢(jian)驗(yan)(yan)機構(gou)要(yao)不斷(duan)跟蹤檢(jian)驗(yan)(yan)科學(xue)前沿技(ji)術和影響人體健(jian)康、人身(shen)安(an)全的關(guan)鍵檢(jian)測技(ji)術,關(guan)注(zhu)各類突(tu)發事件(jian)以及涉(she)及面廣、影響力大的質量安(an)全項目。要(yao)經(jing)常開(kai)展對檢(jian)驗(yan)(yan)方法和檢(jian)驗(yan)(yan)技(ji)術的研究(jiu),積極(ji)參加檢(jian)驗(yan)(yan)機構(gou)管(guan)理部門組織的有(you)關(guan)比對試(shi)驗(yan)(yan),開(kai)展檢(jian)測結果不確定度(du)的研究(jiu)分析。要(yao)對檢(jian)驗(yan)(yan)技(ji)術人員實行持證上崗(gang)制度(du),提高(gao)檢(jian)驗(yan)(yan)能力和技(ji)術水平,保證檢(jian)驗(yan)(yan)結果的科學(xue)性(xing)和準確性(xing)。

(八(ba))實行信息報送制度(du)。各(ge)檢(jian)(jian)(jian)驗(yan)機構要(yao)加強質(zhi)量(liang)(liang)信(xin)息(xi)的報送(song),各(ge)檢(jian)(jian)(jian)驗(yan)機構對(dui)在檢(jian)(jian)(jian)驗(yan)工(gong)作中發現(xian)的質(zhi)量(liang)(liang)信(xin)息(xi)要(yao)向(xiang)(xiang)同級質(zhi)量(liang)(liang)技(ji)(ji)術(shu)監(jian)督部門(men)報送(song)。對(dui)在產(chan)品質(zhi)量(liang)(liang)檢(jian)(jian)(jian)驗(yan)工(gong)作中發現(xian)的帶(dai)有區域性(xing)、普遍(bian)性(xing)及社會關注的重(zhong)大產(chan)品質(zhi)量(liang)(liang)信(xin)息(xi),要(yao)立即向(xiang)(xiang)同級質(zhi)量(liang)(liang)技(ji)(ji)術(shu)監(jian)督部門(men)和國家質(zhi)檢(jian)(jian)(jian)總局報告,不(bu)得隨意向(xiang)(xiang)外泄露(lu)。

(九)建立公(gong)正、廉(lian)潔的工作制度。檢(jian)驗機構不(bu)得(de)(de)在承(cheng)擔監(jian)(jian)督(du)檢(jian)驗任務(wu)(wu)期間接(jie)受(shou)(shou)被抽(chou)查(cha)企(qi)業同類產(chan)品(pin)的(de)委托(tuo)檢(jian)驗;不(bu)得(de)(de)設計、開發、生產(chan)、銷售授權檢(jian)驗范圍內的(de)產(chan)品(pin);不(bu)得(de)(de)向社會(hui)推薦生產(chan)者的(de)產(chan)品(pin);不(bu)得(de)(de)以對產(chan)品(pin)進行(xing)監(jian)(jian)制、監(jian)(jian)銷等名(ming)(ming)義參與(yu)企(qi)業經營活(huo)動(dong);不(bu)得(de)(de)以檢(jian)驗機構名(ming)(ming)義開展產(chan)品(pin)質(zhi)(zhi)量(liang)評比活(huo)動(dong);不(bu)得(de)(de)借各級質(zhi)(zhi)量(liang)技術(shu)(shu)監(jian)(jian)督(du)部門的(de)名(ming)(ming)義從事(shi)各類經營活(huo)動(dong);不(bu)得(de)(de)搞亂評比、亂發牌匾;不(bu)得(de)(de)泄漏企(qi)業技術(shu)(shu)秘密(mi)及商(shang)業秘密(mi)、轉移企(qi)業提(ti)供的(de)有(you)關技術(shu)(shu)資(zi)料和產(chan)品(pin)、利用(yong)企(qi)業技術(shu)(shu)資(zi)料研(yan)制、開發產(chan)品(pin);不(bu)得(de)(de)利用(yong)國家監(jian)(jian)督(du)抽(chou)查(cha)等政府監(jian)(jian)督(du)檢(jian)驗機會(hui),強行(xing)要求被抽(chou)查(cha)企(qi)業接(jie)受(shou)(shou)收費性(xing)質(zhi)(zhi)的(de)服務(wu)(wu)或(huo)強迫被抽(chou)查(cha)企(qi)業簽訂(ding)檢(jian)驗服務(wu)(wu)合同;不得接受商業賄賂。

(十(shi))建立實施檢驗工作責任考核制度。檢驗(yan)(yan)(yan)(yan)機構要(yao)建立檢驗(yan)(yan)(yan)(yan)人員互查制度(du)、檢驗(yan)(yan)(yan)(yan)質(zhi)量(liang)考核獎懲制度(du)、檢驗(yan)(yan)(yan)(yan)過錯責(ze)任追究制度(du)要建立由機(ji)構負(fu)責人負(fu)責的工(gong)作質量監督小組,形(xing)成長(chang)效管理機(ji)制。要(yao)按(an)照(zhao)權責一致的原則,實行“誰(shui)檢(jian)驗(yan)(yan)、誰(shui)審批,誰(shui)負責”。檢(jian)驗(yan)(yan)機(ji)構(gou)不(bu)(bu)得偽造檢驗(yan)數據、隨意更改檢驗(yan)結(jie)論,或者依據主觀臆斷(duan)出具檢驗(yan)報告;不(bu)(bu)得超越授權范圍和授權有(you)(you)效期出具檢測結(jie)果(guo)或報告;不(bu)(bu)得出具虛假(jia)證(zheng)明及(ji)與檢驗(yan)業務無關(guan)(guan)的(de)(de)證(zheng)明;不(bu)(bu)得擅自(zi)泄露行(xing)政執(zhi)法(fa)和監督抽查的(de)(de)有(you)(you)關(guan)(guan)信息。檢(jian)驗機(ji)構不得擅自(zi)對(dui)企(qi)業的(de)產(chan)品質(zhi)(zhi)量開展監督檢(jian)驗,要嚴(yan)格按(an)質(zhi)(zhi)量技術監督部門的(de)監督抽查(cha)計(ji)劃和規定(ding)進行抽樣,按(an)程序及時完成檢(jian)驗工(gong)作,并做(zuo)好(hao)異議的(de)處理。

(十一)建立定期(qi)自查、定期(qi)報告(gao)制度。檢(jian)(jian)(jian)驗(yan)(yan)(yan)(yan)機構要按照國(guo)家有關規定,定期開(kai)展自(zi)查(cha)。每(mei)年(nian)(nian)向同級質(zhi)量(liang)技術(shu)監(jian)督部門提交1份年(nian)(nian)度(du)(du)(du)自(zi)查(cha)總結報(bao)告(gao)(gao),報(bao)告(gao)(gao)本(ben)年(nian)(nian)度(du)(du)(du)產品質(zhi)量(liang)檢(jian)(jian)(jian)驗(yan)(yan)(yan)(yan)的工作狀況,本(ben)年(nian)(nian)度(du)(du)(du)檢(jian)(jian)(jian)驗(yan)(yan)(yan)(yan)能力變化,包(bao)括認可授(shou)權檢(jian)(jian)(jian)驗(yan)(yan)(yan)(yan)產品范(fan)圍的變化、主要人(ren)(ren)員的變化(含機構負責人(ren)(ren)、技術(shu)負責人(ren)(ren)、質(zhi)量(liang)負責人(ren)(ren)、報(bao)告(gao)(gao)授(shou)權簽字人(ren)(ren)、報(bao)告(gao)(gao)審核(he)人(ren)(ren)員、新(xin)增檢(jian)(jian)(jian)驗(yan)(yan)(yan)(yan)技術(shu)人(ren)(ren)員等)、主要檢(jian)(jian)(jian)驗(yan)(yan)(yan)(yan)設備的變化、檢(jian)(jian)(jian)驗(yan)(yan)(yan)(yan)水平的變化(包(bao)括比對試驗(yan)(yan)(yan)(yan)、檢(jian)(jian)(jian)驗(yan)(yan)(yan)(yan)結果(guo)(guo)不確定度(du)(du)(du)的分(fen)析(xi)情況等)、檢(jian)(jian)(jian)驗(yan)(yan)(yan)(yan)報(bao)告(gao)(gao)的缺陷率和異(yi)議率;報(bao)告(gao)(gao)是(shi)否存在出具(ju)虛(xu)假檢(jian)(jian)(jian)測結果(guo)(guo)或檢(jian)(jian)(jian)驗(yan)(yan)(yan)(yan)報(bao)告(gao)(gao)等違法違規行(xing)為及其處理情況。

三、加大對檢驗機構的監管力度,建立長效監管機制

(十二(er))實(shi)行統一規(gui)范(fan)的分級監管制度(du)。各級質量(liang)監技術督部門要(yao)落(luo)實產(chan)品(pin)質(zhi)量檢驗(yan)機構監(jian)管(guan)職責,明(ming)確監(jian)管(guan)部門(men)和責任(ren)。要(yao)加強(qiang)對監(jian)管(guan)人員考核,依法行(xing)政,實現檢驗機構監(jian)管(guan)工作的法制(zhi)化(hua)、規范化(hua)、制(zhi)度化(hua),建立(li)長效監(jian)管(guan)機制(zhi)。國(guo)家質(zhi)檢(jian)總局統一管(guan)理全(quan)國(guo)檢(jian)驗機(ji)(ji)構(gou)(gou)的(de)(de)(de)監(jian)管(guan)工(gong)(gong)作,制定對檢(jian)驗機(ji)(ji)構(gou)(gou)監(jian)管(guan)的(de)(de)(de)方(fang)針、政策、法規(gui)和規(gui)范(fan)性(xing)文件,指導(dao)地(di)(di)(di)方(fang)質(zhi)量技(ji)術(shu)(shu)監(jian)督(du)(du)部(bu)門(men)(men)開展對檢(jian)驗機(ji)(ji)構(gou)(gou)的(de)(de)(de)日常監(jian)管(guan)工(gong)(gong)作,檢(jian)查地(di)(di)(di)方(fang)質(zhi)量技(ji)術(shu)(shu)監(jian)督(du)(du)部(bu)門(men)(men)的(de)(de)(de)工(gong)(gong)作質(zhi)量,重點(dian)對國(guo)家級檢(jian)驗中心、副省(sheng)級以上檢(jian)驗機(ji)(ji)構(gou)(gou)的(de)(de)(de)監(jian)管(guan)。各省(sheng)級質(zhi)量技(ji)術(shu)(shu)監(jian)督(du)(du)部(bu)門(men)(men)依法具體負責(ze)本行(xing)政區內(nei)的(de)(de)(de)省(sheng)、市(地(di)(di)(di))、縣檢(jian)驗機(ji)(ji)構(gou)(gou)的(de)(de)(de)日常監(jian)管(guan)工(gong)(gong)作,全(quan)面履行(xing)監(jian)管(guan)職責(ze),落(luo)實監(jian)管(guan)責(ze)任(ren)。

(十三)實行檢(jian)驗機構監管例會制度。各級質(zhi)量(liang)技術(shu)監(jian)督(du)部(bu)門(men)要(yao)定期舉(ju)辦關于檢驗(yan)機構(gou)監(jian)管的通報會,與檢驗(yan)機構(gou)實行互動(dong),采取措施(shi)解決檢驗(yan)機構(gou)發(fa)展(zhan)和檢驗(yan)工(gong)作中出(chu)現的問(wen)題,及時向(xiang)上(shang)一(yi)級質(zhi)量(liang)技術(shu)監(jian)督(du)部(bu)門(men)報告監(jian)管工(gong)作中發(fa)現的重(zhong)大問(wen)題,并提出(chu)解決問(wen)題的建議,報告檢驗(yan)機構(gou)負責人等重(zhong)要(yao)信(xin)息的變(bian)更。

(十四)實(shi)行檢驗能力提升定期(qi)規劃制度。各級(ji)質量技術監督部門(men)每(mei)年要(yao)(yao)(yao)對(dui)所監管的(de)(de)(de)(de)檢(jian)(jian)驗(yan)(yan)(yan)機(ji)構(gou)(gou)開展(zhan)能(neng)(neng)(neng)力(li)(li)(li)調查,要(yao)(yao)(yao)根(gen)據本行(xing)政區(qu)域經濟(ji)(ji)發(fa)(fa)展(zhan)的(de)(de)(de)(de)需要(yao)(yao)(yao),建立檢(jian)(jian)驗(yan)(yan)(yan)機(ji)構(gou)(gou)戰略發(fa)(fa)展(zhan)和(he)能(neng)(neng)(neng)力(li)(li)(li)提(ti)(ti)升(sheng)實施方(fang)案(an),加(jia)強(qiang)對(dui)檢(jian)(jian)驗(yan)(yan)(yan)機(ji)構(gou)(gou)檢(jian)(jian)驗(yan)(yan)(yan)裝備、人(ren)才(cai)隊伍和(he)管理體系(xi)的(de)(de)(de)(de)建設(she),提(ti)(ti)升(sheng)能(neng)(neng)(neng)力(li)(li)(li)和(he)水平,努(nu)力(li)(li)(li)培育我國的(de)(de)(de)(de)國際(ji)(ji)知名檢(jian)(jian)驗(yan)(yan)(yan)機(ji)構(gou)(gou),適應加(jia)入(ru)WTO新要(yao)(yao)(yao)求,滿足國家(jia)和(he)地方(fang)經濟(ji)(ji)建設(she)發(fa)(fa)展(zhan)的(de)(de)(de)(de)需要(yao)(yao)(yao)。國家(jia)級(ji)檢(jian)(jian)驗(yan)(yan)(yan)中心要(yao)(yao)(yao)加(jia)強(qiang)同(tong)國內外同(tong)行(xing)的(de)(de)(de)(de)技術交流(liu),跟蹤(zong)國際(ji)(ji)先進技術標(biao)準和(he)檢(jian)(jian)驗(yan)(yan)(yan)技術,查找自身(shen)差距(ju),制定(ding)切實可(ke)行(xing)的(de)(de)(de)(de)檢(jian)(jian)驗(yan)(yan)(yan)能(neng)(neng)(neng)力(li)(li)(li)提(ti)(ti)升(sheng)規(gui)劃(hua)并采取有(you)效措施保證實施。各級(ji)地方(fang)檢(jian)(jian)驗(yan)(yan)(yan)機(ji)構(gou)(gou)要(yao)(yao)(yao)根(gen)據地方(fang)經濟(ji)(ji)發(fa)(fa)展(zhan)的(de)(de)(de)(de)特點和(he)需要(yao)(yao)(yao),規(gui)劃(hua)提(ti)(ti)升(sheng)自身(shen)的(de)(de)(de)(de)檢(jian)(jian)驗(yan)(yan)(yan)能(neng)(neng)(neng)力(li)(li)(li),更好(hao)地為地方(fang)經濟(ji)(ji)建設(she)發(fa)(fa)展(zhan)提(ti)(ti)供(gong)服務。

(十五)實(shi)行檢驗人員執業資格管理制度(du)。各級質(zhi)(zhi)量(liang)技術(shu)監(jian)督部門要加強對檢(jian)驗(yan)人(ren)(ren)員(yuan)(yuan)(yuan)隊(dui)伍的建(jian)(jian)設(she)和(he)管理(li),按照國家質(zhi)(zhi)檢(jian)總局要求(qiu),逐(zhu)步建(jian)(jian)立并實施檢(jian)驗(yan)人(ren)(ren)員(yuan)(yuan)(yuan)執業(ye)資(zi)格(ge)管理(li)制(zhi)度(du),凡未取得(de)執業(ye)資(zi)格(ge)的,不得(de)從事檢(jian)驗(yan)工作(zuo)。要采取措施,制(zhi)定切實可行的管理(li)辦法,開展對檢(jian)驗(yan)技術(shu)人(ren)(ren)員(yuan)(yuan)(yuan)的資(zi)格(ge)考核工作(zuo),提(ti)高技術(shu)人(ren)(ren)員(yuan)(yuan)(yuan)的政治水平(ping)、業(ye)務素質(zhi)(zhi)和(he)組織(zhi)紀律(lv)性(xing)。

(十六)實行比對試驗制度。各級(ji)質量技術(shu)監督(du)部門要(yao)根據檢(jian)(jian)驗(yan)(yan)(yan)(yan)(yan)(yan)(yan)機構(gou)(gou)(gou)檢(jian)(jian)驗(yan)(yan)(yan)(yan)(yan)(yan)(yan)工作開展的(de)(de)情況,定期組(zu)織(zhi)檢(jian)(jian)驗(yan)(yan)(yan)(yan)(yan)(yan)(yan)機構(gou)(gou)(gou)進行比(bi)對(dui)試(shi)(shi)驗(yan)(yan)(yan)(yan)(yan)(yan)(yan),全面掌握檢(jian)(jian)驗(yan)(yan)(yan)(yan)(yan)(yan)(yan)機構(gou)(gou)(gou)的(de)(de)能力和水(shui)平,并組(zu)織(zhi)分(fen)析(xi)(xi)比(bi)對(dui)試(shi)(shi)驗(yan)(yan)(yan)(yan)(yan)(yan)(yan)結(jie)(jie)(jie)果(guo)(guo)的(de)(de)離(li)散性,找(zhao)出檢(jian)(jian)驗(yan)(yan)(yan)(yan)(yan)(yan)(yan)技術(shu)水(shui)平差(cha)距的(de)(de)原因;分(fen)析(xi)(xi)測試(shi)(shi)結(jie)(jie)(jie)果(guo)(guo)不(bu)確定度,找(zhao)出提(ti)高確保檢(jian)(jian)驗(yan)(yan)(yan)(yan)(yan)(yan)(yan)結(jie)(jie)(jie)果(guo)(guo)準確可靠的(de)(de)措(cuo)施;分(fen)析(xi)(xi)檢(jian)(jian)驗(yan)(yan)(yan)(yan)(yan)(yan)(yan)結(jie)(jie)(jie)果(guo)(guo)失真(zhen)的(de)(de)主、客(ke)觀因素,提(ti)出對(dui)策,提(ti)高檢(jian)(jian)驗(yan)(yan)(yan)(yan)(yan)(yan)(yan)機構(gou)(gou)(gou)的(de)(de)檢(jian)(jian)驗(yan)(yan)(yan)(yan)(yan)(yan)(yan)技術(shu)水(shui)平和檢(jian)(jian)驗(yan)(yan)(yan)(yan)(yan)(yan)(yan)結(jie)(jie)(jie)果(guo)(guo)的(de)(de)科學性。各級(ji)質量技術(shu)監督(du)部門要(yao)通過經常性的(de)(de)對(dui)比(bi)試(shi)(shi)驗(yan)(yan)(yan)(yan)(yan)(yan)(yan),了解檢(jian)(jian)驗(yan)(yan)(yan)(yan)(yan)(yan)(yan)機構(gou)(gou)(gou)的(de)(de)檢(jian)(jian)驗(yan)(yan)(yan)(yan)(yan)(yan)(yan)技術(shu)水(shui)平,對(dui)比(bi)試(shi)(shi)驗(yan)(yan)(yan)(yan)(yan)(yan)(yan)結(jie)(jie)(jie)果(guo)(guo)嚴重失真(zhen)的(de)(de)檢(jian)(jian)驗(yan)(yan)(yan)(yan)(yan)(yan)(yan)機構(gou)(gou)(gou),要(yao)責令限期整改(gai)。檢(jian)(jian)驗(yan)(yan)(yan)(yan)(yan)(yan)(yan)技術(shu)水(shui)平低的(de)(de)檢(jian)(jian)驗(yan)(yan)(yan)(yan)(yan)(yan)(yan)機構(gou)(gou)(gou),不(bu)得承擔(dan)監督(du)抽查任務。

(十(shi)七)實行定期和不定期監督檢(jian)查制度。各級質(zhi)量技術(shu)監督部門(men)要按照各自的(de)(de)職責(ze),依據法律、法規(gui)等規(gui)定(ding)(ding)(ding),采用定(ding)(ding)(ding)期(qi)(qi)(qi)檢(jian)(jian)(jian)查和(he)不(bu)定(ding)(ding)(ding)期(qi)(qi)(qi)抽查相結合的(de)(de)監管(guan)方式,實(shi)行制(zhi)度化(hua)監管(guan)。開(kai)展對所負責(ze)監管(guan)的(de)(de)檢(jian)(jian)(jian)驗(yan)機構(gou)的(de)(de)定(ding)(ding)(ding)期(qi)(qi)(qi)監督檢(jian)(jian)(jian)查和(he)不(bu)定(ding)(ding)(ding)期(qi)(qi)(qi)的(de)(de)監督抽查,原則(ze)上每(mei)年不(bu)少于(yu)1次,主要檢(jian)(jian)(jian)查檢(jian)(jian)(jian)驗(yan)機構(gou)是否存在違(wei)法、違(wei)規(gui)、違(wei)紀的(de)(de)行為;檢(jian)(jian)(jian)查檢(jian)(jian)(jian)驗(yan)工作流程(cheng)的(de)(de)完整性和(he)檢(jian)(jian)(jian)驗(yan)報告、記錄等技術(shu)資料的(de)(de)齊(qi)全性、真(zhen)實(shi)性;檢(jian)(jian)(jian)查檢(jian)(jian)(jian)驗(yan)所用儀器(qi)、設備的(de)(de)準確性和(he)有(you)效性。確定(ding)(ding)(ding)檢(jian)(jian)(jian)驗(yan)機構(gou)質(zhi)量體系運行是否有(you)效,保證檢(jian)(jian)(jian)驗(yan)工作質(zhi)量。

(十八)實行檢驗機(ji)構年度考(kao)評制度各級質量(liang)技(ji)術監督部門要加強(qiang)對(dui)檢(jian)(jian)驗機(ji)構檢(jian)(jian)驗工作業(ye)績、工作質量以及投訴處(chu)理情況的(de)考核,對(dui)優秀檢(jian)(jian)驗機(ji)構給(gei)與獎(jiang)勵,對(dui)違規(gui)檢(jian)(jian)驗機(ji)構進行(xing)嚴(yan)肅查處(chu),完善(shan)政府監督和社會監督機(ji)制。

四、加大監督力度,嚴格責任追究

(十九)強化對檢驗機構(gou)的督察制度。各(ge)級質量(liang)技(ji)術監督部門要(yao)利用多種管理(li)方式對檢驗機(ji)(ji)構進(jin)行(xing)督察。要(yao)重視對檢驗機(ji)(ji)構的舉報、投(tou)訴和反饋信息的核(he)查(cha),及時發現(xian)并(bing)查(cha)處(chu)違(wei)法、違(wei)規、違(wei)紀行(xing)為(wei)。要(yao)重視對檢驗機(ji)(ji)構弄(nong)虛(xu)作假(jia)、出具虛(xu)假(jia)檢驗結(jie)果和檢驗報告等行(xing)為(wei)的調查(cha)處(chu)理(li),杜絕虛(xu)假(jia)報告,保證檢驗機(ji)(ji)構檢驗結(jie)果的公正性。

(二十)強化(hua)對(dui)檢驗(yan)機構的(de)責任追究(jiu)制度。各級質(zhi)(zhi)量(liang)技術監督部門在(zai)(zai)監管中,發現檢(jian)驗(yan)(yan)機(ji)構(gou)工(gong)作中存在(zai)(zai)嚴重(zhong)違反(fan)工(gong)作程序、出(chu)現檢(jian)驗(yan)(yan)過程或結果重(zhong)大失(shi)誤的(de)(de),要(yao)(yao)給(gei)予通報(bao)批(pi)評(ping),1年內2次(含)被通報(bao)批(pi)評(ping)以及連續(xu)2年被通報(bao)批(pi)評(ping)的(de)(de),依(yi)法給(gei)予檢(jian)驗(yan)(yan)機(ji)構(gou)負責人(ren)紀律處分(fen),暫(zan)停其(qi)檢(jian)驗(yan)(yan)資格(ge)。對檢(jian)驗(yan)(yan)機(ji)構(gou)存在(zai)(zai)弄(nong)虛(xu)(xu)作假(jia)、出(chu)具虛(xu)(xu)假(jia)報(bao)告、偽造篡改檢(jian)驗(yan)(yan)結果、檢(jian)測報(bao)告嚴重(zhong)失(shi)實等造成惡劣影(ying)響的(de)(de)行(xing)為,要(yao)(yao)追(zhui)究檢(jian)驗(yan)(yan)機(ji)構(gou)和(he)負責人(ren)的(de)(de)責任,并按照《中華人(ren)民共和(he)國產品(pin)質(zhi)(zhi)量(liang)法》的(de)(de)規定進(jin)行(xing)處罰(fa),依(yi)法撤(che)銷其(qi)負責人(ren)的(de)(de)職務,撤(che)銷其(qi)檢(jian)驗(yan)(yan)資質(zhi)(zhi);情節嚴重(zhong)的(de)(de),依(yi)法追(zhui)究刑事責任。

(二十(shi)一(yi))強化對監管(guan)部門的責任追究制度。各級(ji)質量技(ji)術監督(du)部(bu)門要建立責(ze)任(ren)追(zhui)(zhui)究(jiu)制度,對在監管(guan)工作中所發現的(de)各類問題(ti),要查明(ming)原因、找出責(ze)任(ren)部門和(he)責(ze)任(ren)人(ren)(ren)、嚴(yan)格依法追(zhui)(zhui)究(jiu)相關人(ren)(ren)員的(de)責(ze)任(ren),并落實(shi)糾正(zheng)和(he)預(yu)防(fang)措(cuo)施,舉一反三(san),防(fang)止類似問題(ti)的(de)出現;對監管(guan)不(bu)力、玩(wan)忽(hu)職守(shou)或縱容(rong)包庇(bi)檢(jian)驗(yan)機構(gou)違法、違規、違紀行為的(de),要追(zhui)(zhui)究(jiu)主管(guan)部門和(he)責(ze)任(ren)人(ren)(ren)員的(de)行政責(ze)任(ren)。
